## And Letter to the Governor:
**Phuket, 17 July 2024**
**Dear Governor of Phuket, Khun Kitty, and Khun Bew,**
**I am writing to express our deep frustration regarding the ongoing issue of illegal kindergartens, schools, and nurseries operating without licenses while advertising extensively on social media.**
## **Key Issues**
**Licensed institutions are suffering immense pressure due to the tolerated operations of illegal establishments, seemingly endorsed by the Salagan Department of Social Development.**
**The fact that even licensed schools are seeking ways to circumvent existing laws and regulations is alarming. Despite more than six months passing, no effective measures have been taken to support licensed schools by closing down illegal ones that have been operating for over a year without even attempting to apply for a license.**
**There is a critical need for those who inspect the schools to also be scrutinized, as without their contributions, no illegal school could exist. Previously, the nursery department was much stricter, resulting in fewer illegal institutions. However, over the past 2-3 years, there has been a significant increase in the number of illegal institutions or those operating under inappropriate licenses.**
## **Additional Concerns**
**Now even more schools seem to operate under the umbrella of other schools instead of obtaining their own license, as has been happening for many years. People are employed by these schools with a license but are located far from the school they are working at, and these schools are under entirely different legal entities and companies. Why do you allow and tolerate such practices in Phuket for years?**
**Why are the officers that check these educational institutions not held accountable and required to report in a short time frame instead of a six-month waiting period with no answers or significant measures against these illegal practices?**
## **Examples of Issues Threatening Legal Institutions**
**Baan Meerak: This institution is running a franchise business in several villa areas while many legal institutions are no longer allowed to operate in villa areas. Baan Meerak operates in Dowroong Villa, Samkong Villa, and a villa area in Thalang. What are the requirements for a franchiser? Can they reuse the license of the headquarters in a villa area in Kathu, and why are they allowed to operate in areas where new nurseries, schools, and kindergartens are not permitted?**
**Schools in Hotels: Some institutions have opened in hotels but have decided to close down, planning to reopen next year. What measures are in place to either legalize schools in hotels, which often have bars, nightlife businesses, and unsecured swimming pools, or to ensure they will not be allowed to operate in such environments in the future?**
**Misuse of Licenses: Schools that have closed down but whose premises and licenses are now used by other schools under different names and companies. Why are your officers allowing such practices? This misuse is not in accordance with Thai laws and regulations.**
**Guardian Visas: The practice of providing guardian visas for parents is akin to a money-printing machine for schools. Many parents seek ways to stay in Phuket, often disregarding the legality of their visas. What measures are in place to address this issue, and why are some language schools offering such services?**
**Overloading and Boarding Facilities: Schools are extending their student numbers without involving your officers, often running boarding facilities without licenses. This practice is apparently tolerated by your officers at Salagan (2nd Floor North Wing).**
## **Urgent Requests**
**Publish and Verify Licensed Schools: We request the publication of a complete list of all licensed educational institutions in Phuket to begin a discussion about transparency.**
**Inspect and Take Action: Immediate action is required against institutions operating without a license or beyond the scope of their issued licenses.**
**Schedule a Meeting: We urgently request a meeting with the Phuket Governor to discuss these pressing issues.**
## **Immediate Concerns**
**Why is Phuket not following the example of Surat Thani, where many illegal educational operations on Koh Phangan have been shut down, and offenders fined and arrested?**
**Will regulations be eased for legal schools, nurseries, and kindergartens to level the playing field, allowing them to employ more foreigners, issue guardian visas, and manage higher student numbers like the illegal ones?**
